The Kosovo Property Comparison and Verification Agency (KPCVA) was established by the Kosovo Assembly on 9 June 2016 under Law 05/L-010, which entered into force in November 2016. This law was subsequently supplemented by Law 08/L-052 on 26 January 2023. The KPCVA is an independent agency pursuant to Article 142 of the Constitution of Kosovo. Its mandate is to receive, compare, and resolve discrepancies between old and current Kosovo cadastral documents regarding immovable property, including agricultural and commercial properties.
With the establishment of the KPCVA, the Kosovo Property Agency (KPA) ceased to exist. The Law on KPCVA transferred all competencies, budget, contractual obligations, and physical assets from the KPA to the KPCVA. In preparation for its new mandate, the KPCVA has undertaken various actions to ensure a successful transition and implementation of the law. Many of these actions have already been completed, while some are still in progress.
The Kosovo Property Comparison and Verification Agency was established as a result of the agreement between Kosovo and Serbia regarding the return of cadastral records displaced by Serbia in 1999.
The Agency is responsible for receiving, registering, and processing claims for the recognition of property rights informally transferred before 24 March 1999. This includes comparing 4,037,264 cadastral documents returned from Serbia with current records in Kosovo to resolve discrepancies and complete the Kosovo cadastral register.
Pursuant to Law 05/L-010, the Kosovo Property Comparison and Verification Agency (KPCVA) has inherited the mandate of the Kosovo Property Agency (KPA). This mandate includes resolving ownership and use rights claims for private immovable properties, including agricultural and commercial properties, related to the war period in Kosovo (27 February 1998 – 20 June 1999). These claims are now handled by the KPCVA through the Property Claims Commission (PCC), with the right of appeal to the Supreme Court of Kosovo.
The Agency has the authority to implement decisions of the KPA, as well as those of the Housing and Property Directorate (HPD), established under UNMIK Regulation 1999/23. The KPCVA is responsible for implementing the final decisions of the PVAC, the PCC, the Housing and Property Claims Commission (HPCC), and the judgments of the Supreme Court Appeals Panel.
The implementation of these decisions is carried out through the prescribed legal remedies, such as registering decisions in cadastral registers, property administration by the KPCVA, eviction, demolition of illegal structures, and rental agreements. Mediation may be used as an alternative remedy for implementing decisions related to the demolition of illegal structures.
The Supervisory Board is composed of five members, three international and two local, appointed in accordance with the legislation in force. It oversees the work of the KPCVA and provides guidance on the policies and orientation of the Agency, but does not participate in the decision-making of the PVAC and the PCC. The Director of the Executive Secretariat represents the Executive Secretariat before the Board. The Executive Secretariat provides administrative services to the Board, including organizing meetings, distributing documents and monitoring actions according to the instructions of the Board.
Two Board members are appointed by the Assembly upon the proposal of the Prime Minister, while three members of the Board are appointed by the EUSR, including one local representative from the non-majority community. The Chairperson of the Board is elected by the Board.
